Article 1 – General
1.1 MNH Scandinavian Design & Living is registered in the Trade Register under number 81326157 and is located in Beverwijk - the Netherlands. The business address is Melis Stokelaan 18, 1948 DA Beverwijk. The VAT number is NL003557328B38, IBAN number NL14KNAB0604134762.

1.2 These general terms and conditions apply to all offers, orders and agreements from MNH Scandinavian Design & Living.

1.3 By placing an order you indicate that you agree to the delivery and payment conditions. MNH Scandinavian Design & Living reserves the right to change its delivery and/or payment terms.

1.4 The provisions of these general terms and conditions may only be deviated from if this has been expressly agreed in writing and in which case the other provisions of these general terms and conditions remain in full force.

Article 2 – Delivery
2.1 Delivery takes place while stocks last.

2.2 Delivery will take place between 1 and 3 working days. Unless otherwise stated on the website. If the delivery time of up to 3 working days is not met, the customer will receive an email from MNH Scandinavian Design & Living stating the correct delivery time. In that case, the customer has the right to terminate the agreement with MNH Scandinavian Design & Living by reporting this in writing (by letter or e-mail) to MNH Scandinavian Design & Living.

2.3 Any payments already made by the customer will be deposited into the customer's bank account as soon as possible, but in any case within fourteen working days after MNH Scandinavian Design & Living has received the request for termination of the agreement referred to in the previous article (article 2.2). refunded.

2.4 If MNH Scandinavian Design & Living needs information from the buyer to execute the agreement, the delivery time will only start after the correct and complete information has been received by MNH Scandinavian Design & Living.

2.5 Delivery takes place at the address specified by the buyer during the conclusion of the agreement, including delivery due to absence at the post office or neighbors/third parties indicated by the buyer. The risk of the delivered products passes to the buyer at the time of delivery.

2.6 If the buyer refuses delivery, MNH Scandinavian Design & Living may charge the resulting costs to him. In addition, MNH Scandinavian Design & Living has the right to terminate the agreement in that case, without prejudice to the right to claim total damages.

Article 3 – Returns
3.1 After the customer has received the item he/she ordered, the customer has the authority to terminate the underlying agreement with MNH Scandinavian Design & Living within fourteen (14) days of receipt of this item. The customer does not have to give a reason for this.

3.2 If the customer wishes to terminate the agreement in accordance with Article 3.1 of these general terms and conditions, the customer must return the item in the correct and undamaged packaging, after consultation with MNH Scandinavian Design & Living by email
([email protected]), to be returned to an address determined by MNH Scandinavian Design & Living. In this case, the customer must bear the costs and risk of shipping himself.

3.3 MNH Scandinavian Design & Living will reimburse payments received from the customer no later than seven (7) days after receipt of the return.

MNH Scandinavian Design & Living reserves the right to refuse returned items or to credit only part of the amount already paid if it is suspected that the item has already been opened, used or due to the fault of the customer (other than those from MNH Scandinavian Design & Living or the supplier of the item) is damaged.

3.4 Article 3.1 does not apply to:
• Products created in accordance with the buyer's specifications
• Be clearly personal in nature
• Due to their nature they cannot be returned

3.5 If an item is returned that, in the opinion of MNH Scandinavian Design & Living, has suffered damage that is attributable to an act or negligence of the customer or is otherwise at the customer's risk, MNH Scandinavian Design & Living will notify the customer in writing. (via letter or e-mail). MNH Scandinavian Design & Living has the right to deduct the depreciation in value of the item as a result of this damage from the amount to be refunded to the customer.

Article 4 - Payment and shipping
4.1 All prices stated on the website are in euros and include legally determined sales tax (VAT).

4.2 Prices will not be increased within the term of the offer, unless legal measures make this necessary or if the manufacturer implements interim price increases.

4.3 All prices on the website are subject to printing and typographical errors. No liability is accepted for the consequences of printing and typographical errors.

4.4 The consumer can choose from the following payment methods: iDeal, Bancontact, Credit Card, post-payment via Riverty (formerly AfterPay) or via a gift voucher from MNH Scandinavian Design & Living

4.5.1 In collaboration with Riverty, we also offer consumers (living in the Netherlands and Belgium) post-payment. Payment must be made to Riverty.

4.5.2 Riverty processes your personal data to complete the payment of your order. More information about this can be found in our payment terms and conditions and Riverty's privacy statement at: https://www.riverty.com/nl-nl/privacybeleid/.

4.5.3.1 The general payment terms of Riverty Group GmbH apply to all payments via the Riverty system. The sole proprietorship MNH Scandinavian Design & Living, Melis Stokelaan 18, 1948 DA Beverwijk, Chamber of Commerce number 81326157, VAT number 0035.57.328.B38, holder of the webshop www.mnh-scandinaviandesign-living.nl, has transferred its claim to you to Riverty. This means that you can only pay to the AfterPay account number mentioned above.

4.6 A gift voucher cannot be used to purchase a new gift voucher. The remainder of a gift voucher cannot be exchanged for money. The remaining amount of a gift voucher remains open for a subsequent purchase.

4.7 Any discount code must be entered during the ordering process. After completing the order, the discount code cannot be used retroactively.

4.8 For shipping within the Netherlands, MNH Scandinavian Design & Living charges shipping costs depending on the size and weight. For orders over €50, shipping costs are free within the Netherlands.

4.9 For shipping within the EU, MNH Scandinavian Design & Living charges shipping costs depending on the size and weight. Shipping costs are free for orders over €175 within the EU.

4.10 For shipping to other countries outside the EU, MNH Scandinavian Design & Living must be contacted before placing an order via [email protected].

4.11 All orders are shipped via Post-NL, the customer will receive a track & trace code by email.

4.12 From September 1, 2019, packages must be collected via PostNL within 7 days. After this, the package will be returned to MNH Scandinavian Design & Living. Return, reshipment and original shipment costs will not be reimbursed and will be at the customer's expense.

4.13 MNH Scandinavian Design & Living is not responsible if the customer has provided an incorrect address when ordering and the package cannot be delivered. The costs for resending the order are for the customer.

Article 5 – Guarantees
5.1 The products to be delivered by MNH Scandinavian Design & Living meet the usual requirements and standards that can reasonably be imposed on them at the time of delivery and for which they are intended during normal use. If applicable, the products supplied by MNH Scandinavian Design & Living are subject to warranty provisions from suppliers and third parties such as manufacturers and importers.

5.2 The buyer is obliged to check the delivered products immediately upon receipt. Any apparent defects must be reported to MNH Scandinavian Design & Living in writing and with reasons within 10 days - and in the case of external defects immediately - in writing and with reasons. In the case of consumer purchases, a period of 2 months applies after discovery of any defects.

5.3 If it has been demonstrated that a product does not comply with the agreement and a complaint has been filed in a timely manner, MNH Scandinavian Design & Living has the choice to replace the product in question or to refund the invoice price plus shipping costs paid.

5.4 This warranty does not apply if the defect is due to 1. neglected care, or 2. intentional damage, or 3. inattention.

5.5 Warranty claims lapse if service/repair services other than those designated by the manufacturer have carried out repairs or other work on the item.

5.6 All data, models and images regarding colours, materials, sizes and finishing are indicative. Deviations herein cannot constitute a reason for rejection, discount, termination of the agreement or compensation, if these deviations are of minor significance.

5.7 MNH Scandinavian Design & Living is never liable for damage or defects caused by or resulting from incorrect installation or use of products.

Article 6 – Agreement
6.1 An agreement between MNH Scandinavian Design & Living and a consumer is concluded after an order or assignment has been assessed for feasibility by MNH Scandinavian Design & Living.

6.2 MNH Scandinavian Design & Living reserves the right not to accept orders or assignments without giving reasons or to accept them only on the condition that shipment is made after payment in advance.

Article 7 – Privacy
7.1 If you place an order with MNH Scandinavian Design & Living, your data will be included in the customer base of MNH Scandinavian Design & Living. MNH Scandinavian Design & Living complies with the Personal Records Act and will not provide your data to third parties.

7.2 MNH Scandinavian Design & Living respects the privacy of the users of the website and ensures confidential treatment of your personal data.

7.3 Personal data entered by the customer will be included in a file. This data will be used for the execution of the customer's order. This data will not be provided to third parties.

7.4 For the purpose of processing the agreement, we may pass on the data provided by the customer to the shipping company that has been commissioned to carry out the delivery, if this is necessary for the delivery of ordered goods.

7.5 Depending on the payment service provider selected by the customer during the ordering process, we pass on the payment data collected for this purpose to the credit institution for the purpose of processing payments and, if necessary, to the payment service providers working on our behalf or to the selected payment service. The selected payment service providers also collect some of this data themselves, provided that the customer has created an account there. In that case, the customer must log in to the payment service provider with his login details during the ordering process. The privacy statement of the respective payment service provider applies. MNH Scandinavian Design & Living also receives information about the payment from the customer's bank or credit card company.

Article 8 – Communication
8.1 MNH Scandinavian Design & Living is in no way liable for misunderstandings, damage, delays or unclear clarity of orders and communications as a result of the use of the internet or any other means of communication in the traffic between the customer and MNH Scandinavian Design & Living, or between MNH Scandinavian Design & Living and third parties, insofar as it relates to the relationship between the customer and MNH Scandinavian Design & Living.

8.2 MNH Scandinavian Design & Living is not liable for information and web content sent by users without its knowledge. MNH Scandinavian Design & Living is also not responsible for the web content and information of websites that are in any way linked to the online store www.mnh-scandinavian-design-living.nl. MNH Scandinavian Design & Living is not liable for any form of damage, direct or indirect, related to the website.

Article 9 - Force majeure
9.1 MNH Scandinavian Design & Living is not liable if and insofar as its obligations cannot be fulfilled as a result of force majeure.

9.2 Force majeure means any external cause, as well as any circumstance that should not reasonably be at its risk. Delays or non-performance by our suppliers, transport difficulties, strikes, government measures, delays in supply, negligence of suppliers and/or manufacturers of MNH Scandinavian Design & Living, as well as of auxiliary persons, illness of staff, defects in auxiliary or transport equipment are expressly considered force majeur.

9.3 In the event of force majeure, MNH Scandinavian Design & Living reserves the right to suspend its obligations and is also entitled to dissolve the agreement in whole or in part, or to demand that the content of the agreement be changed in such a way that execution remains possible. . Under no circumstances is MNH Scandinavian Design & Living obliged to pay any fine or compensation.

Article 10 – Complaints
10.1 All complaints relating to the delivery, quality, condition of the item or any other complaint will be taken seriously by MNH Scandinavian Design & Living.

10.2 The customer must submit a complaint in writing to MNH Scandinavian Design & Living (letter or e-mail).

10.3 MNH Scandinavian Design & Living will attempt to resolve the complaint within seven (7) working days. MNH Scandinavian Design & Living will inform the customer about this in writing (by letter or e-mail).

Article 11 - Intellectual and industrial property rights
11.1 The customer must fully and unconditionally respect all intellectual and industrial property rights that apply to the goods delivered by MNH Scandinavian Design & Living.

11.2 MNH Scandinavian Design & Living does not guarantee that the goods delivered to the customer do not infringe any intellectual and/or industrial property rights of third parties and does not accept any liability in the event of any claim from third parties based on the statement that an Item delivered by Design & Living infringes any right of a third party.

Article 12 - Applicable law and dispute resolution
12.1 Dutch law applies to all offers, orders and agreements from MNH Scandinavian Design & Living.

12.2 Disputes arising from an agreement between MNH Scandinavian Design & Living and the customer, which cannot be resolved by mutual agreement, will be submitted exclusively to the competent court in the Haarlem district.
